Valentine's Day - INSTAGRAM CONTEST GAME RULES

Getaround SAS ( a French company with capital of 1,231.552.50 euros - RCS Paris n°522 816 651 - registered office at 35 rue Greneta 75002)) and Getaround Inc (Delaware corporation - registered office at 55 Green Street, San Francisco, CA 94111) together referred to as "Getaround" have decided to launch a competition on its respective Instagram pages accessible via @getaround_europe, @getaround_norge, @getaround_es and @getaround (the "Game") to offer four (4) Participants a Prize (defined below). 

Participation in the Game implies unreserved acceptance and submission of these Game rules, which set out the terms and conditions (the "Rules"), Getaround's general terms and conditions of use, available here (the "TOU"), Getaround's privacy policy, available here (the "Privacy Policy"), and the rules of conduct in force on the Internet (etiquette, codes of conduct, etc.). 

Any breach of one or more of the above conditions may, at Getaround's discretion, result in the Participant's disqualification from the Game. 

Article 1. Conditions of participation 

1.1. This Game is open to anyone meeting the following cumulative conditions (the "Participant"): 

  • registered as a renter on the Getaround platform (i.e. registered on the platform to rent a vehicle);
  • residing in France, Belgium, Germany, Austria, Spain, Norway or the United States; be of age in his country of residence; 
  • with access to an Internet connection, and; 
  • with a valid email address. 

1.2. All employees and representatives of Getaround, its partners and subcontractors, as well as their advisors and family members (direct ascendants and descendants) and spouses (marriage, civil partnership, cohabitation) and minors are excluded from all benefits of the Game. 

Article 2. Terms and conditions of participation 

The Game runs from Wednesday, February 14, 2024 at 6 p.m. until February 21st, 2024 at 6 p.m. (the "Game Period"). 

Participation in the Game is as follows: 

- On Wednesday, February 14, 2023 at 6pm, Getaround will publish a post on each of its respective Instagram accounts (@getaround_europe, @getaround_norge @getaround_es and @getaround) indicating the terms and conditions of the Game and the link to the Rules; 

- During the Game Period, Participants must: 

  • subscribe to the Getaround Instagram account for your country of residence (@getaround_europe for France, Belgium, Austria and Germany, @getaround_norge for Norway, @getaround_es for Spain or @getaround for the USA); 
  • Like the post announcing the Game on the Getaround Instagram account in your country of residence; 
  • tag one (1) person of their choice in the comments section of the publication announcing the Game on the Getaround Instagram account in their country of residence. Multiple comments per Participant are accepted, provided that the people tagged in each comment are different. 

Participants who do not comply with all these conditions will not be able to attempt to win the Prize, without being able to claim any compensation in any form whatsoever. 

Article 3. Lot 

The prize offered by Getaround is four (4) coupons, one for each Getaround Instagram account (@getaround_europe, @getaround_norge, @getaround_es and @getaround), to book a vehicle in your country of residence on the Getaround platform (fr.getaround.com, be.getaround.com, fr.be.getaround.com, at.getaround.com, de.getaround.com, es.getaround.com, no.getaround.com and getaround.com). These coupons have a value of two hundred euros (200€) for @getaround_europe and @getaround_es, two thousand two hundred and eighty-five Norwegian kroner (2.285kr) for @getaround_norge and two hundred and fifteen dollars (215$) for @getaround. They are valid for six (6) months from the date of issue, and may be used in installments during the validity period. 

Article 4. Designation of the winner and award of the Prize

4.1. At the end of the Game Period, four (4) Participants will be designated by a random draw carried out by Getaround's marketing team, via the Random Picker tool for each Instagram account: @getaround_europe, @getaround_norge @getaround_es and @getaround. 

4.2. The Participants selected in the draw will be contacted by Getaround by private message on Instagram. If the designated Participants: (i) cannot be contacted; (ii) do not respond within three (3) days of the message from Getaround and/or (iii) refuse the Prize, they definitively waive their right to receive the Prize without any subsequent compensation being claimed in this respect. In this case, another Participant will be designated under the same conditions as those defined in article 4.1. 

4.3. After contacting the designated Participants and verifying that they comply with all of the Rules, in particular by submitting to any additional verifications required by Getaround, the selected Participants will be definitively declared winners of the Contest (the "Winners"). 

4.4. Once their details have been confirmed, and within a maximum of seven (7) working days, the Winners will receive the Prize by e-mail (which will be sent to them by Getaround). The Prize is personal and may not be exchanged, given in cash, reimbursed or transferred. The Winners will be responsible for the use of the Lot before its expiry date. Any Lot not used during its validity period will lapse. 

4.5. The results of the Game will be communicated to other Participants by mentioning the Winner's first name and/or Instagram pseudonym in the comment section of the Game publication and in stories on Getaround's Instagram accounts (@getaround_europe, @getaround_norge, @getaround_es and @getaround). The Winners authorize Getaround to communicate the aforementioned information in stories. In the event that Winners do not wish their first name and/or Instagram handle to be communicated, Winners must inform Getaround in advance. 

Article 5. Processing of personal data 

5.1. To participate in the Game, Participants must provide certain personal information about themselves such as their Instagram username or real name. Only Winners will be required to provide their e-mail address or any other identifying information necessary to verify their compliance with the Rules and to be eligible to receive the Prize. 

5.2. Any personal data collected by Getaround will be treated in accordance with their privacy policy accessible via: https://getaround.com/privacy

Article 6. Limitation of liability 

6.1. INSTAGRAM IS IN NO WAY INVOLVED IN THE ORGANIZATION OF THE GAME. THE GAME IS NOT MANAGED, SPONSORED OR ENDORSED BY INSTAGRAM. UNDER NO CIRCUMSTANCES SHALL INSTAGRAM BE HELD LIABLE IN THE EVENT OF ANY DISPUTE RELATING TO THE GAME. FOR ANY QUESTIONS, COMMENTS AND/OR COMPLAINTS REGARDING THE GAME, PARTICIPANTS SHOULD SEND A PRIVATE MESSAGE TO THE GETAROUND INSTAGRAM ACCOUNT (@GETAROUND_EUROPE, @GETAROUND_NORGE, @GETAROUND_ES OR @GETAROUND). 

6.2. Getaround cannot be held responsible for any loss, delay or error, in particular due to a failure of computer equipment, software, Internet browsers, computer networks or Internet connections, whether or not affecting the Participants' computer equipment. 

6.3. Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses circulating on the network. As a result, Getaround cannot be held responsible under any circumstances, and this list is not exhaustive: 

  • the transmission and/or reception of any data and/or information on the Internet;
  • from any malfunction on network Internet preventing the operation of the Game; 
  • failure of any receiving equipment or communication lines; 
  • loss of any paper or electronic mail and, more generally, loss of any data;
  • routing problems; 
  • the operation of any software; 
  • the consequences of any virus, computer bug, anomaly or technical failure;
  • any damage caused to a Participant's equipment; 
  • any technical, hardware or software failure of any kind whatsoever that prevents or limits participation in the Game or damages a Participant's system; 
  • the malfunctioning of the Lot distributed as part of the Game, and any direct and/or indirect damage they may cause. 

6.3. Getaround may cancel all or part of the Game if it appears that fraud has occurred in any form whatsoever, including by computer. Getaround reserves the right, in such an event, not to award the Lot to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts. Getaround shall not however, incur any liability whatsoever towards the Participants as a result of any fraud that may be committed. 

6.4. Getaround reserves the right to definitively exclude from the Game any person who, through fraudulent behavior, interferes with the smooth running of the Game, in particular but not exclusively, through the use of robots or any other automated process. 

6.5. Getaround shall in no event be liable for any loss or damage arising from the acceptance and/or use of the Prize. 

6.6. Getaround reserves the right to cancel, suspend or modify the Game in the event of impossibility to finalize the Game due to an event of force majeure, or any bug, virus, intrusion or technical error. 

Article 7. Literary and Artistic Property Rights 

The images used on Getaround's Instagram account, the objects depicted, the trademarks and trade names mentioned, the graphic elements, the computer elements and the databases making up the Game are the exclusive property of their respective owners and may not be extracted, reproduced or used without the written authorization of the latter, under penalty of civil and/or criminal prosecution. 

Article 8. Reimbursement of participation fees 

If Participants use access providers with telephone and Internet connections based on a flat rate service offer, the connection to take part in the Game is by nature free. Participants choose to take part in the Game at their own discretion, and any costs incurred will not be covered by Getaround. 

Article 9. Applicable law and jurisdiction 

Prior to any legal action relating to or in connection with these Rules (in particular their application or interpretation), Participants undertake to contact Getaround in order to attempt to settle their dispute amicably and out of court. 

Participants are subject to applicable French regulations, except for those residing in the United States, where they are subject to the regulations of the State of California. Any dispute that cannot be settled amicably will be brought before the competent courts in France, except for those residing in the United States where it will be brought before the courts of the city of San Francisco, California.
